Claire Cox LLB

Partner

I am a partner in our highly rated litigation & dispute resolution team. With over 15 years’ experience, I am recognised as a specialist in inheritance and trusts disputes, as well as contentious probate.

Helping clients with claims against estates and the contesting of wills, I often assist on disputes between executors or trustees, estate administration issues, breaches of trust and claims regarding will validity. I am also an expert in dealing with contentious trusts outside of inheritance disputes, for example in cases where an individual considers that they have an interest in a property not legally owned by them (known as TOLATA claims).

I am also an associate member of ACTAPS (the Association of Contentious Trusts and Probate Specialists).

Key skills

I can help you with:

  • investigating will validity disputes – such as undue influence and lack of testamentary capacity
  • defending and bringing claims against an estate under the Inheritance (Provision for Family and Dependants) Act 1975
  • advice on executor disputes
  • actions against executors for breach of duty, or losses arising from failure to administer estates (including professional negligence claims)
  • advice on trust disputes, to guide trustees or in relation to contentious trusts of property where a dispute as to ownership has arisen (TOLATA disputes)
  • advice in relation to misuse of powers of attorney and disputes surrounding validity of lifetime gifts.

Experience highlights

My experience includes:

  • obtaining a six figure award at court for two disabled children who had been left out of their mother’s estate, which had passed to their step-father
  • successfully litigating a contentious trust claim for a client facing a claim by a family member for a beneficial interest in her property
  • conducting multiple online mediations which have resulted in settlements out of court and pragmatic outcomes
  • guiding executors through stalemate where a dispute had arisen
  • providing input to trustees as to how to deal with the trust for the benefit of children, where a dispute had arisen
  • obtaining a discontinuance for a substantial claim against an estate where social media evidence proved to be in direct contradiction to the claimant’s testimony.
